  1. Why does the article call it “radical”?
    The oh-so-cautious-and-respectable ALI is evidently moving in the same direction. It’s obviously the right answer if what you want to do is treat like cases alike and facilitate the rational treatment of various sort of situations people set up for their own purposes. That’s assuming, of course, that “like” and “rational” are interpreted in the individualistic and non-stereotypical manner that all respectable people now agree is required by rationality and the most basic human decency.

    • That’s distressing…
      I’m not very familiar with the ALI, but it’s disturbing to see the sort of thing Ontario pioneered – in its case, the re-writing of all marriage-related legislation to refer now only to “partners” and “spouses” instead of husband and wife – being pursued with vigour, in the U.S.A.

      Incidentally, Canada is now also a pioneer in gay divorce, alas; there’s been at least one high-profile case so far…
